The cost of divorce can be all over the map. Most couples are concerned with getting an affordable divorce. Of course, getting an attorney is not an inexpensive process.

It is important to understand the fee agreement with your attorney thoroughly. Read the fee agreement carefully. Remember that a cheap attorney up front may still not result in an affordable divorce in the long run. Always ask for your fee agreement in writing, to avoid misunderstandings and confusion from arising.

Don't make oral agreements. Discuss and amend any changes that might need to be made in the agreement before signing. Once you have signed the fee agreement, you have indicated that you fully agree to it and it is a legally binding and enforceable contract. This does not mean that you cannot fire your attorney or that your attorney cannot withdraw from the case. You may change attorneys at any time.

Controlling the expenses in a divorce is a difficult task. There are many factors that contribute to the overall total cost that are outside of your attorney's control. These include such factors as the personality and philosophy of your spouse's attorney, as well as the ability and willingness of you and your spouse to cooperate and communicate with each other in your efforts to come to an agreement.

Your fee agreement should cover all services that are covered in your agreement. It should also spell out your obligations as a client. Will there be interest added to unpaid fees? What payment arrangements are agreed upon?

Here are some various types of attorney fee arrangements. Remember that you may have a combination of these in your arrangement:

* Initial Consultation Fee - This fee is what the lawyer charges for your first visit. Ask what the fee is when you make your initial appointment. During the visit, you interview the attorney and tell him about your case, get a feel for his outlook on your case, and also a feel for how comfortable you are with him or her.
* Hourly Fee - This fee can vary from lawyer to lawyer. It can also vary from city to city, the type of lawsuit, and the amount of experience the lawyer has. Ask your lawyer for an estimate of how much time your case will take. But your case may take longer than the lawyer expected at the beginning. Remember that your lawyer will bill every minute spent working for you.
* Flat Fees - This is a fixed fee that you pay for routine legal matters. Ask your lawyer about the services that are included in this fee. If you have a truly uncontested divorce, this may be handled as a flat fee. Most divorces are not handled by flat fee, as the exact amount of time each case may take varies.
* Retainer Fee - There is usually a down payment or security deposit. The lawyer will deduct funds from the retainer as the lawsuit proceeds. The client has to pay another retainer if it is used up. The unused funds may or may not be refundable. Be certain to clarify with the attorney whether they will be refunded - do not assume so.
* In addition, you will have to pay costs and expenses. Discuss this with your attorney before hiring him.
